1. Acceptance of Terms

By accessing and using TortugAds's affiliate tracking platform ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.

2. Description of Service

TortugAds provides an affiliate marketing tracking platform that enables users to:

• Track affiliate campaigns and conversions
• Manage multiple traffic sources and offers
• Analyze performance metrics and generate reports
• Integrate with third-party platforms and networks

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Distribute malware, spam, or other harmful content
• Attempt to gain unauthorized access to our systems
• Engage in fraudulent activities or misrepresent tracking data

5. Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice to existing customers.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data and grant us a license to process it solely for providing the Service.

7. Limitation of Liability

TortugAds shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

8. Termination

We may terminate or suspend your account at any time for violations of these terms. Upon termination, your right to use the Service will cease immediately. You may export your data within 30 days of termination.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

11. Anti-Spam Policy

TortugAds maintains a strict anti-spam policy. You agree not to use our Service to:

• Send unsolicited bulk emails, messages, or communications
• Harvest, collect, or store email addresses or personal data for spamming purposes
• Promote campaigns that use deceptive practices or misleading content
• Generate fake clicks, leads, or conversions through automated means or bots
• Engage in click fraud, ad fraud, or any form of traffic manipulation
• Use our tracking links in unsolicited SMS, email, or messaging campaigns
• Violate CAN-SPAM, GDPR, or other applicable anti-spam regulations

Violations of this anti-spam policy will result in immediate account suspension or termination. We cooperate with authorities investigating spam and fraud activities, and may share relevant data with law enforcement when legally required.

12. Service Availability & Tracking Accuracy

TortugAds provides its tracking services on an "as-is" and "as-available" basis. While we employ commercially reasonable efforts to ensure reliable and accurate tracking of clicks, leads, sales, and other conversion events, we do not guarantee:

• 100% uptime or uninterrupted availability of the Service
• Complete accuracy of all tracked data, including but not limited to clicks, conversions, and attribution data
• That all events will be successfully recorded during server maintenance, outages, or technical incidents

No Liability for Untracked Events. In the event of service disruptions, server failures, software bugs, network issues, or any other technical incident that results in conversion events not being recorded or tracked, TortugAds shall not be held liable for any lost revenue, missed commissions, or unrecorded payouts. Users acknowledge that no retroactive compensation, credits, or payments will be owed for events that were not captured by the platform during such incidents.

Data Reconciliation. Users are solely responsible for maintaining their own independent records and reconciling tracking data with their advertiser platforms, affiliate networks, or other third-party sources. TortugAds tracking data should be used as a reference tool and not as the sole basis for financial settlements between parties.

External Factors. TortugAds is not responsible for tracking discrepancies caused by factors outside our control, including but not limited to: ad blockers, browser privacy settings, third-party cookie restrictions, incorrect postback or pixel configuration by the user, failures of third-party APIs (Meta, Google, TikTok, etc.), or end-user network conditions.
